Service Provider: Medina Lawn Guys (referred to as "the Company," "we," "us," or "our")
Applicability: Applies to all residential and commercial services provided in Ohio.
1. Scope of Services
-
Service Range: We provide lawn care, landscape maintenance, mowing, edging, trimming, and seasonal outdoor services.
-
Property Access: The customer must provide free, unobstructed access to the service areas on scheduled days.
-
Obstructions: Gates must be unlocked, and pets must be secured indoors.
-
Debris Removal: Lawns must be cleared of toys, tools, dog waste, and large debris before service. We are not liable for damage to items left on the lawn.
2. Estimates, Pricing, and Changes
-
Non-Binding Quotes: All online or initial phone estimates are non-binding.
-
Final Pricing: Final rates are confirmed via a formal project scope or written agreement before on-site work begins.
-
Modifications: If we encounter unforeseen site complications (e.g., hidden stumps, drainage issues), pricing may be adjusted with the customer's prior consent.
3. Weather and Scheduling Delay Policies
-
Weather Postponement: Lawn care is highly dependent on local weather conditions.
-
Automatic Rescheduling: In the event of heavy rain, lightning, extreme heat, or saturated soil, services will be automatically shifted to the next available business day.
-
Liability Exemption: The Company is not liable for structural changes, overgrowth, or delays resulting from severe weather acts.
4. Payments, Billing, and Surcharges
-
Accepted Methods: We accept major credit cards, checks, and electronic payments.
-
Payment Due Date: Invoices are due upon receipt or within the timeline specified in your service plan.
-
Late Fees: Past-due balances exceeding 30 days are subject to a late fee or interest charge allowed by Ohio state law.
5. Auto-Renewal and Cancellation Policy
-
Continuous Service: Recurring seasonal packages (e.g., weekly mowing or fertilization plans) automatically renew from month to month or season to season unless explicitly canceled.
-
How to Cancel: To cancel services without penalty, the customer must submit a written request via email or call customer service at least 48 hours prior to the next scheduled visit.
-
Verbal Cancellations: Leaving a single voicemail or making an unconfirmed verbal request may not instantly halt operations. Always ensure you receive a written confirmation of cancellation to avoid accidental billing.
6. Property Damage and Limitation of Liability
-
Marking Utilities: The customer must explicitly notify us of invisible fences, shallow cables, or underground drainage layouts.
-
Liability Cap: Our total legal liability for property issues, omissions, or accidental damage will not exceed the total financial amount paid for the specific service in question.
-
Third-Party Content: The terms on our digital platforms govern only our direct tools; any embedded elements or third-party links are subject to separate compliance standards.
7. Governing Law
-
Jurisdiction: These Terms and Conditions are governed by and construed in accordance with the laws of the State of Ohio. Any legal disputes must be filed and settled in a court of competent jurisdiction within Medina County, OH.
